Question- what do we do to make our farm name offical? It's on the checks but do we need to fill out paperwork for the state,feds,etc. We are getting the ball rolling around here & I want to make sure I have all my ducks in a row.

Hi Heather,

Congratulations on starting your farm business. What I did here in NH was go to the Secretary of State office and fill out a form there. Then they check to see if there are any other names for businesses that match yours or not. If your business name is unique, no others with that name, you're all set. Then I had to pay 100.00 for a year to keep my registered business name. Then I called the IRS to get a tax ID # to use when I file my returns. That was free. My farm business is a summertime venture, although I'd love for it to be my only job!! I want a licensed kitchen so I can sell all the stuff I make like goat cheese, ice cream, jams, pickles, breads, etc... Maybe someday

Hello,

You can set up your business name several ways. It all depends on how committed you are in making your business go and if you want your business name protected nationwide.

1) You can set up your name with the US Trademark office
http://www.uspto.gov/main/trademarks.htm
This will protect your name nationwide. There is a fee for this and all information is on the site.

2) You can go to your local County office and set up a DBA for a nominal fee.
This will only protect your name in your county you live in. It will give you the
ability to use this name for your business no matter where your products are sold and no one can use that name within your county area.

The difference between the two is cost and whether it is important to protect your name nation wide.

I prefer method number 2 due to the cost and the area in which my products are sold.

All your tax information would be filled out on a schedule C on your income tax return.
A seperate Schedule C for your business sent in along with your personal income tax return.

In Ohio I learned that the county DBA "filing" is actually a state sales tax license. Unless I was given bad advice - I am NOT a lawyer!

Once you get it you are required to file your tax returns at least twice a year, whether you actually collect any taxes or not. Since most food products are not taxable in Ohio, I'm not sure whether the extra effort is really worth it or not!
