That is wonderful-
Sherri- the reasoning is that even though you own the land you might not own the mineral or water rights and the rainwater is part of the watershed that feeds the water that can be used as part of the water rights on the land or even on places "downstream" basically the 10 gallons of water that falls on point A where Mr. Smith lives, might not belong to Point A at all as they have shale or whatever under the top soil and the water actually collects at point B naturally where Mrs. Doe lives. So as far as the law for the past 100 years has been concerned- Mr. Smith's rainwater water actually belongs Mrs. Doe because collection at Point A will affect flow rate at Point B.

This is great news for those who live in Colorado--I bet Shane himself is mighty pleased too (sorry, couldn't help it). Cindy

Sharon, thanks for sharing this. I had not heard about this and am so glad they have changed their minds. I never could figure out why you couldn't collect rain water to water your lawn and garden, it will still end up in the ground either way! Just wish I had a rain barrel in place to catch the rain from our 2nd wettest June on record!

Thanks for the tip Alee. We've had that on our list of things to do. I will call around and see what I can find. Sharon, they are some counties in Texas that are making people with new water wells, put meters on them and buy their own water from the water board (can't remember the official name of it.) I, for one think it's robbery! |

My understanding of that was, it is now legal to collect rainwater *if* you have a well permit on your property. That's what we've been told in our county. Of course like our extension agent says "There's no one to monitor rainbarrels, and no consequences in place if someone were to catch you". But you didn't hear that from me! |

I'm very excited and have plans to add barrels to mom's house. I have a sod roof so more difficult for me. Still skeeming though.

thanks for posting this article... i'd seen on the local news (i'm only 8 miles from the CO border) a story about how it was illegal. never understood it. but i'm glad it's legal now! and thank you , Alee, for your suggestion! my hubby and i went online to look for the closest bottling plant so we could pick up some of those drums.
