Hello farmgirls, I need your help. My neighbors dogs have killed my hens again. This is the third time and I saw them this time. I sent both neighbors a certified letter with the cost of the chicken tractor, 4 hens, future egg production about 2 weeks ago. I asked them for full pymt within 10 days of receiving letter. Have not heard from one (who is a deputy sheriff in my county) so I called him today and asked if he was going to do anything about it, he said they together would pay $50.00 for the hens but "no judge anywhere will make us pay for future egg production". So I need help with any law you all can help me with, looks like we are going to court! Thanks!!!
By the way its in Alabama.

I do have pics and the deputy that originally filed the report actually saw the dead hens himself. I'm gonna try and file Friday, if my finances allow.

This makes me SO mad. I can't believe you're still dealing with this! Thought of it again when my sister in law called to say someone had shot her dogs, one limped home and died, the other went to the vet and had a LOT of money dumped into it. I said "Well, where were the dogs when they got shot?" She said "Out running." She's new to farm country so I explained to her that her dogs REALLY can't run now (they shouldn't have been pre-farm country either...) because now if they are lose on someone else's property (especially if they are harassing livestock) they can be shot. She just went off about how she didn't know how someone could be so "mean." I told her she better hope she doesn't have someone knocking on her door asking her to pay for chickens, goats, cows...whatever. Some people just don't get it!!! GRRRRRRR. Looking forward to your updates!

well thought I would let you all know, the dogs were running loose yesterday. Still no return call from state dept of ag. I'm going to try and file in sm claims this week. Thanks for all the support and advice. Will keep you all posted.

I wish I could give you some better advice, but beyond warning the neighbors that next time you WILL shoot them, I don't really have anything new to add. I'm looking forward to updates on this though!

Thanks Ginny, I'm have tried contacting our state dept of agiculture, with no response from them. I will try the state police.

Kim, Have you thought about reporting it to the State Police? Since the Sheriff isn't willing to "contain" his Deputy it seems to me you need to go higher on a law enforcement level. My DH works for our Sheriff and he would NEVER allow this behavior by one of his Deputies. He (Sheriff) has made it clear that no one is above the law, including them and we should report anything to him.

Kathyrn, so sorry about your ordeal and sorry your brother acted the way he did! Great advice, maybe I will even call the tv station. They have a segment when people have been ripped off.

That is downright wrong that the deputy is being allowed to get away with that,I believe as Gandhi said that when there is injustice,we must make the injustice visible so I would go to your local newspaper or write them and make the story very,very public.
I had this same issue with my Sister in Law/neighbor's dogs killing my rabbits and the whole thing really blew up when one of the dogs bit my Daughter,it caused a huge family war when this freak of a woman vandalized my vehicle,livestock fencing and killed some of my animals in retaliation so we moved away from them and now I will never speak to my own Brother again,he is a stranger to me now.
Anyways,you've gotten alot of good advice there from all these gals but I would go a bit further and make the situation as public as you can,tell everyone about it and about the police response and make this injustice visible.

Thanks everyone for all the support. Just got up ( I work 3rd shift) to get ready for work and guess what, the dog was in my neighbors yard loose. Was told it was contained... it does make my afraid of what this neighbor is capable of doing or his good ole boys what might do while I am going the 25 min to work. Keep me in your prayers! My advice is to catch the dogs, take them way out somewhere and practice the 4s, this is just so wrong on so many levels, wish I was closer, I would take care of it for you....

Heather-Exactly what I was thinking! People who do things like that are capable of much worse. Frankly I'm afraid of our nearest neighbors for this very reason.
I feel for anyone dealing with people like that. Especially if they live so close.

WOW To me this is scary on a lot of levels. There is a scripture that says faithful in least, faithful in most. Meaning a person who makes sure to be faithful to God in even the small details, will be even more apt to be faithful to God in the larger things. But, also visa verse. People who try to get away with the small things, will be more likely to try to get away with the bigger things.

This dog law is a "smaller" law, yet this deputy is being allowed to get away with it! I would be very afraid of what BIG things they will allow him to get away with!

Sounds like my neighbors. I feel for you cause I know what it is to deal with this. As much as I hate to advocate killing a dog the 4 S's may end up being your only resort.
I'll bet they haven't been neutered either. Macho s---'s never neuter their dogs. Makes me ill.

TRAP!!!! I have 3 dogs... & It is my duty to keep them under control. It is so sad that people have no respect... We have a leash law here. So sorry... I wish I could help you.

Kim that is horrible! I think it is strange that they won't do anything about the deputy. I asked my husband (a deputy) who went off about how your neighbor is breaking the law and just because your neighbor a deputy doesn't mean ANYTHING. I hope something happens in small claims court. It shouldn't be so difficult to deal with, you know? :(

Update... one more hen killed Tuesday. I went to sheriffs dept and they will still not do anything about the deputy so I am going to file a small claims suit next week. Will keep you all posted.

Dogs will be dogs unfortunately, but the owners of the dogs need to take care of the situation. My neighbor's dog came over and killed my chickens too. I went over and told them and showed them a dead chicken. Fortunately my neighbor is a good neighbor and they apologized, offered to pay for the chickens and have kept their dog contained since. I accepted their apology, refused their money (might as well keep friendly neighbors, next time it could be one of my animals causes trouble), and am thankful their dog is not over here causing trouble. I've seen it once since on my place and I yelled for it to go home and it took off like a shot. I'm sorry your neighbors are being turds. I'd check the laws to make sure but my understanding is that if a dog is coming to your place and causing trouble you have the right to shoot it. I had to do this once. Neighbors had dogs that were packing up and roaming around killing calves, sheep etc. One of them came to our place and growled at my family and caused some hassle with my livestock. Three times I took the dog back to the owners and asked them to keep it confined because it was causing trouble. The fourth time I shot it. When their dog didn't come home they called asking if it was there, I answered truthfully, yes it's dead. My neighbor came up to support me when they came to get their dog and informed them that her husband would have shot it if I hadn't and a ton of other neighbors were going to do the same. I had called the police before I did anything and received conformation that I was within my rights. It doesn't make it any more pleasant and it doesn't help neighbor relations a whole lot but they aren't making much of an effort at neighbor relations either and you need to protect your family and livestock.

I called the sheriffs station here where I live, know several personaly, they said the same thing, your deputy neighbor is WRONG, and breaking the law, and should be reported and sued...
