I am so happy right now! I am literally jumping around the house!

I just spoke with Farmer's Insurance and due to the amount of evidence that I have backing up the local market value of my car, they have decided to settle for more than double the amount that they originally offered me for my totaled car!

Hi Sherri!

According to Idaho State law, the insurance company must pay you the "Cash" value of the car as it was the day before the accident happened. So I went on www.autotrader.com and searched within a 150 mile radius for the exact year, make, and model of my car. I then excluded the ones that had more mileage and called asking about the remaining (not many). The cheapest ones were what are called a "rebuilt title" car which means at some point they were damaged to the point of being totaled and were rebuilt. Those should be excluded from the search parameters as well as they are about 50% less valuable as good cars.

Unfortunately, most companies use a 3rd party evaluation company that does searches but I don't think they discount the price of the rebuilt title cars AND they don't always search in your area.

So I presented them with the law (Farmers, you _have_ to give me cash value) and then I presented them with evidence of the cash value (a specific 3-4 vehicles I found on Auto Trader and the information the dealer gave me about what they would be willing to take for a cash purchase). So I am getting almost (forgive me I'm not bragging, just trying to illustrate a point) $8,000 whereas they only wanted to give me $3000.

I also told them that if they weren't willing to give me what the law calls a "good faith settlement" aka the cash market value of my car, then I would contract legal aid and take them to court.

The Idaho Insurance Commission was extremely helpful and I don't think I will EVER make a insurance settlement without consulting my state Commission first. They know the laws and are more than willing to help the average person get the proper settlement amount.

Like I told the Farmer's rep that I was dealing with (once he gave me a good faith settlement #) I don't want to try and make out better in this situation that I was before it; I just don't want to be in a worse position! Any asset that we own is important to us, whether it be a car, house, or property and damage to it can be extremely scary for someone without disposable income.

Thank you ladies! I know all the positive thoughts that you have been sending my way helped our situation immensely. We have a line on a 2004 Ford Taurus with 64000 miles on it. This would be wonderful for our family. Safe, newish, low mileage (ish). So keep your fingers crossed that our meet with the sales people goes well tomorrow!

Good for you, Alee, for standing up for yourself and not just taking "what they'll give you". I work for a law firm that represents several LARGE national insurance companies and suffice it to say...you're right about a lot of it :)
